Terms of Service

1. Overview of Services

Dominate Media ("we," "us," or "our") operates a lead generation service that connects home service companies ("you," "your," or "the Company") with potential customers who are seeking services in your trade and service area. We identify, screen, and deliver leads to participating service companies on a pay-per-lead basis.

2. Eligibility

To use our services, you must be a legitimate business operating in a home service trade, including but not limited to plumbing, HVAC, electrical, appliance repair, roofing, and cleaning. You must provide accurate information about your business, trade, service area, and contact details. You are responsible for holding any licenses, insurance, and certifications required to operate in your jurisdiction.

3. Lead Delivery and Pricing

We charge a flat fee of $20 CAD per qualified lead delivered to your business. A qualified lead is defined as a real customer who:

• Is actively seeking a service in your trade
• Is located within your specified service area
• Has expressed genuine intent to book or schedule a service

You will be charged only for qualified leads delivered to you. You will not be charged for clicks, impressions, price inquiries without booking intent, spam, wrong numbers, or contacts outside your specified service area.

4. Exclusivity of Leads

Each lead delivered to your business is exclusive to you. We do not sell, share, or distribute the same lead to multiple companies. Once a lead is delivered to you, it will not be offered to any other service company.

5. Payment Terms

You agree to provide a valid payment method upon registration. You will be billed automatically as qualified leads are delivered. All fees are in Canadian Dollars (CAD) unless otherwise stated. Charges are non-refundable except in cases where a lead is determined to be unqualified under the criteria described in Section 3.

6. Disputing a Lead

If you believe a lead you were charged for does not meet the qualification criteria, you may dispute the charge by contacting us within seven (7) days of delivery. We will review the dispute in good faith and, if the lead is found to be unqualified, the charge will be credited or refunded.

7. No Guarantee of Conversion

While we deliver qualified leads with genuine booking intent, we do not guarantee that any lead will result in a completed job, sale, or revenue. Conversion depends on factors within your control, including your response time, pricing, professionalism, and service quality. Our obligation is limited to delivering qualified leads as defined in these terms.

8. Your Responsibilities

You are solely responsible for your interactions with customers we refer to you, including scheduling, pricing, performing services, collecting payment, and resolving any disputes. Dominate Media is not a party to any agreement between you and a customer. We do not perform services, handle customer payments for services, or assume any liability for the work you perform.

9. Cancellation

You may pause or cancel your participation at any time, with no penalty or cancellation fee. Upon cancellation, you remain responsible for payment of any qualified leads delivered prior to cancellation.

10. Prohibited Conduct

You agree not to misuse our services, including by providing false business information, disputing valid leads in bad faith, reselling or redistributing leads we provide, or using leads for any purpose other than offering your legitimate services.

11. Limitation of Liability

To the maximum extent permitted by law, Dominate Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the total amount you paid to us in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Dominate Media from any claims, damages, or expenses arising from your services performed for customers, your violation of these terms, or your violation of any applicable law or third-party right.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes, and your continued use of our services after such changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
